A joint defense led by Thompson Coburn and the general counsel for Federal Signal Corporation (FSC) ultimately absolved the company from any liability in a lawsuit brought by a former Philadelphia firefighter who claimed he developed hearing loss due to the Company’s warning siren on Philadelphia fire trucks.
After a one-week trial, a Philadelphia, PA jury ruled in favor of the defense on Nov. 17. The jury deliberated for less than two hours before returning a verdict in favor of the Company, finding that the Company’s siren was neither defective nor was FSC negligent in its design of the siren.
The successful defense was the seventh of its kind in the past six weeks, according to a statement from FSC’s vice president and general counsel.
Jan Paul Miller a partner of Thompson Coburn’s business litigation group and chair of the firm’s white-collar defense and investigations practice, represented FSC. “We are gratified that for the second time in a little over a month a jury has found that our siren is safe,” Miller said. “Our string of trial victories shows the firefighter claims regarding Federal Signal’s warning siren are baseless.”
